After serving one year of his five-year sentence, Oscar Pistorius will be heading back to prison– the South African Supreme Court of Appeal has just convicted him of murder. He is currently serving his sentence on house arrest at his uncle’s home in Pretoria.

On Feb. 14, 2013, Pistorius killed his girlfriend Reeva Steenkamp after shooting four times through a locked bathroom door in their home. He claimed that he thought he was shooting at an intruder.

Previously a lower court had convicted him of the lesser charge of manslaughter but that has been overturned by the Supreme Court. According to the BBC,the rule of dolus eventualis– whether the defendant knew that a death would be likely because of their actions– was not applied by the lower court.

In South Africa, the minimum sentence for murder is 15 years. A person cannot serve more than five years of their sentence on house arrest either.

That means that Pistorius will be heading back behind bars however that date is to be determined.
