Pistorius, the only amputee to ever win an able-bodied world championship medal, was charged with the murder of girlfriend Reeva Steenkamp after the court overturned a lesser charge of culpable homicide last month.

Andrew Fawcett, Pistorius’ lawyer, issued the following statement:

“The application has been served on the director of public prosecutions. They will now indicate when they will be opposing the application and what the grounds of opposition will be. Then we wait for the constitutional court to make a ruling on whether or not they will hear the appeal.”

On Feb. 14, 2013, Valentine’s Day, Pistorius shot four times through the bathroom door at his home in South Africa — claiming that he mistook Steenkamp for an intruder.

Pistorius, 29, is currently on bail and under house arrest while he awaits his murder trial — he is expected to appear in court again on April 18, according to a previous report.

A murder charge comes with a 15-year sentence but his sentence may be reduced due to being a first time offender as well as already having served time.
